This argument has been exploding into courtrooms because of the increased divorce rates. Because of the complexity and the fact that the federal government does not want to get involved in religion, the local courts often have contradictory rules.
The main problem in cases like these is conflicts between the rights of parents and the interests of children. The courts need to try and not violate the first amendment freedoms to religion without endangering children.
Case law is fragmented, but courts have ruled that one or both parent’s religious activities were not in the best interest of a child. In some cases, the child’s own viewpoint is considered by the court. In one case, a appellate court sent a case back down to the lower court so they could gather evidence on a child’s wishes. Courts will often rule in this way for children over 12 for both religious conflicts and general custody and visitation rights. However, the supreme court has not yet ruled on this issue, so often the law varies from state to state. Some places that have “cult” religions are particularly troubled by this problem. In one example, Denver family law attorneys argued that child custody and religion is something that should never come up in Denver divorce courts. Most states use one of three standards to decide on child custody standards.
One is called the actual substantial harm test, where courts will only curtail first amendment rights if the practice causes harm to the child. Another standard is called the risk of harm standard, and applies earlier – if the religion will likely harm the child in the future. A Ohio case against Jehovah’s Witnesses ruled that going against community norms and imposing social restrictions is not harmful. However, another case ruled that threats or physical actions to force children to do a particular religion are not lawful.

Driving under the influence of alcoholic beverages, chemical substances or controlled substances can result in the conviction of DUI. Colorado law states you are in direct violation if your blood alcohol content (BAC) is .08% or higher. However, Colorado law, unlike some other states, says that a person is still in violation if their blood alcohol is between .05% and .0799% BAC, resulting in a Driving While Ability Impaired (DWAI).
Every DUI/DWAI case is different, so penalties are mandated based on the specific circumstances, including a person’s BAC at the time of arrest and prior offenses, but the state of Colorado does have minimum and maximum penalty limits. A person should know, however, that DUI/DWAI laws may or may not apply if there is a violation of the rights during their arrest or police station stay.
There are some very important things a person should know about know the consequences of a Denver DUI. First and foremost on people’s minds involves their driver’s license. After a DUI arrest a person’s license is revoked 7 days later, meaning a person has a very short time period to contest the revocation if they believe it should be reinstated, and can be done by going to the Colorado Department of Revenue.
A first-time offense will face a driver’s license loss for a time period from 30 days to a year, with no possibility of a getting an early license renewal. Fines, on top of the revoked license, can range from $300 to $1,000. Jail time, as well, may be ordered, and could be anywhere from 5 days to a year, with community service, alcohol education classes and probation as other options. Treatment, as deemed fit, may be able to replace jail time.
A second-time offense has a couple different consequences based on the time period from a person’s first DUI offense. If the offense has been more than five years since the first conviction, then the consequence is a license revocation for 180 days to one year without the possibility of early hardship license reinstatement. Most repeat offenders are ordered to go to alcohol education classes, as well. If the second offense happens within five years of the first offense, however, the consequences are greater. A person is then looking at a five-year license revocation and mandatory jail time of at least 10 days, with completion of DUI education required in accordance of Colorado DUI laws. When I started my Denver law firm I was confronted with many choices. What kind of law will I practice? Where will I practice? Who do I want for clients? What kind of fees will I charge? It wasn’t until I actually got into the planning stages of the law firm that I began to see these questions as more big picture, firm philosophy type of questions. These type of questions may never be fully answered because they are not static.
One big picture question that is static and that can have a profound effect on the success of your firm is its name. What’s in a name? A lot if you think about it. Think about your own name for starters. What if you had been named something different? What if you were a boy and had been given a girls name? What if you were born in a particular religion and were given a name not associated with that religion? Have you ever been to a place where for some reason your name was looked down upon? These same types of feelings can be encountered with your Denver law firm name.
The great thing about starting a Denver law firm is that you get to think about this and plan ahead. If you are starting a law firm and are reading this article, you are probably either fairly young, fairly technologically proficient, or both.
